When an ordinary errand becomes an injury

Pembroke Pines Premises Liability Lawyer

An injury at a Pembroke Pines store, residential common area, or other property can leave you unsure who was responsible. Miller & Jacobs investigates the condition, the relevant property roles, and the records needed to evaluate a claim. We can begin with the place, time, and documents you have rather than an assumption about who owns the problem.

Your consultation is free. No attorney fee is owed unless compensation is recovered for you. The written fee agreement explains fees and costs.

Record the approach

If safe, keep photographs showing the hazard, surroundings, lighting, and any warning from the direction you approached. Retain original files and damaged belongings. Explain what you observed before and after the injury without estimating details you do not know.

Keep the incident information

Save report copies or numbers and correspondence with staff, management, or an insurer. Record witness contact information. A verbal assurance that someone will take care of it may not preserve your legal rights or identify the correct insurance company.

Identify records held elsewhere

Surveillance, inspection logs, work orders, and earlier complaints may require requests to the proper record holder. A lawyer can assess preservation and lawful access. For a temporary business substance, timing and recurrence can be important under section 768.0755.

The proof required

Different conditions call for different legal tests.

Premises liability is broader than a spill claim. We examine the duty, the condition, notice where required, and causation. The investigation should fit the event rather than force every property injury into the same checklist.

The condition

A temporary substance

For covered business-establishment slips, actual or constructive knowledge must be proved. Duration or regular recurrence may support constructive knowledge. A fall by itself does not show that the business knew of a substance, nor does the absence of a timestamp settle every notice issue.

The duty

A lasting defect

A damaged stair, unstable fixture, or other defect may involve maintenance history, control, and different duty questions. Reports of earlier problems and repair records may help. The business-spill statute should not be described as the universal rule for every hazardous property condition.

The dispute

Disputed visitor conduct

Warnings, visibility, and conduct may be raised as defenses. In covered negligence cases, comparative-fault law reduces recovery and bars it above 50% claimant fault. We examine the evidence behind the allegation instead of treating an insurer's statement as a final answer.

An injury on property does not by itself prove negligence. The condition, legal duty, notice, control, and connection to the injury must be assessed.

Back home with new limits

The injury can disrupt more than the errand.

The injury can disrupt more than the errand.

Save receipts for necessary assistance and transport, along with employer records and medical restrictions. Do not abandon a prescribed course of care to collect evidence. A family member may be able to keep paperwork organized while you focus on treatment.

A free consultation

Find out who controlled the area.

Call 954-465-8733 for a free consultation about a property injury, incident records, or a proposed settlement. The firm can assess whether the facts support further investigation. Fees and costs are explained in a written agreement if representation is accepted.

Treatment and restrictions

Save provider names, bills, referrals, and work restrictions. Give clinicians a truthful history, including prior symptoms. The records should explain a new injury or aggravation and the resulting limits, rather than assume every later medical issue came from the incident.

Income and daily activity

Keep pay records, missed-work details, necessary expenses, and examples of tasks that became difficult. Future losses may require additional evidence. The value of a claim is individual; a bill total or online estimate does not establish an appropriate settlement.

Deadlines and proposals

Many current negligence actions have a two-year limit under Florida section 95.11. Other theories and government defendants can require different review. Before signing a release, understand its scope, unresolved care, and the available evidence.

Care and treatment

Past and reasonably anticipated medical care related to the injury, including follow-up and rehabilitation.

Work and income

Missed work, reduced earnings, or an affected ability to earn, where supported by the facts.

Daily life

Physical pain and the loss of ordinary activities that the injury has caused, assessed in the context of the claim.

What if the injury happened in an HOA common area?

Identify the exact area, the association or manager, and any maintenance information you have. Responsibility may depend on control, governing documents, contracts, and the condition involved. An association's connection to the property does not automatically establish negligence or resolve who should receive a claim.

Can a tenant and property owner both be involved?

Potentially, if the facts and law support responsibility for each. Leases, retained control, maintenance duties, and actual conduct can matter. A lawyer can investigate the relationships. Simply listing both parties without connecting their obligations to the injury does not establish liability.

Do I need a video to have a premises claim?

No single evidence type is required in every case. Photographs, witnesses, inspections, maintenance history, and medical evidence may also be useful. A claim still needs proof of the applicable legal elements. If video may exist, identify the place and time promptly so preservation can be considered.

What if I signed an incident form at the business?

Keep a copy and explain when and why you signed. An incident report, medical authorization, and settlement release have different purposes. The document's wording and circumstances matter. Do not assume a form either ends the claim or has no legal consequence without reviewing it.

Can prior pain affect the claim?

A prior condition may be relevant to causation and damages, but it does not automatically prevent a claim for a new injury or aggravation. Give an accurate medical history. The evidence should explain what changed after the incident and avoid attributing unrelated treatment to it.

How do I start without all the records?
